Terms and Conditions

1. General
The following conditions apply exclusively, even if not referred to in individual cases, to all our offers, sales and deliveries with immediate effect. By placing an order, the customer agrees to the terms. Different agreements are only valid if they are confirmed by us in writing.

2. Order Returns
The dispatch is at the discretion of the seller, but without guarantee for the cheapest shipping. Shortages, freight damage and faulty goods must be reported to the seller within 14 days after receipt of the goods. Customers who refuse acceptance of the goods ordered or do not pick them up at the post office bear the cost of shipping, handling and restocking.

3. Prices and payments
The prices on our website are ex warehouse in GBP, inclusive of any applicable VAT, plus postage. Prices subject to change.
The invoice amount is, if no other method of payment is agreed upon, collected without any deduction for cash on delivery or invoice. In any case, all the goods remain the seller's property until full payment.

4. Finishing of the goods
Slight variations in colour, shape and function are reserved. Descriptions and visual representations are only approximate.

5. Completeness of delivery
The vendor assumes no responsibility for the completeness of the delivery. If an item desired by the customer cannot be delivered entirely or in part, despite the promised stocks, the provider will try to inform the customer of this. Should coordination with the customer not be possible, the fully or partially unavailable item will be removed from the scope of delivery and the actual quantity delivered will be reported on the delivery note. The validity of the remaining order items remains unaffected.

6. Cancellation and return policy
You can cancel your contract within 14 days without giving reasons, in writing (eg letter, fax, email) or - if the goods are delivered before the deadline expires - by returning the goods. The period begins upon receipt of this notification in writing, but not before receipt of the goods by the consignee (in case of recurring deliveries of similar goods, not before receipt of the first partial delivery), and also not before the fulfilment of our information obligations under Article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB (Introductory Statue to the Civil Code) and our obligations according to § 312g paragraph 1 sentence 1 BGB (Civil Code) in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or good shall be deemed sufficient for compliance with the revocation period. Freight collect returns will not be accepted. In case of a return, the buyer will be refunded the shipping costs incurred (only customary postal charges). (Please specify bank details for refund) With used articles on which wear or use characteristics and damage is evident, the customer has to pay compensation for the deterioration through proper usage. The deliveries are to be checked for deficiencies and shortfalls immediately upon receipt, and these are to be reported without delay in a letter, at least within 14 days of shipment date, to Michael Bieg, Liebigstrasse 40, 65428 Rüsselsheim / Germany, Phone +49 6142 35 95 600.

7.Warranty
1. We are liable under the law in so far as the buyer makes claims for damages based on intent or gross negligence. If we are not accused of intentional breach of contract, the liability for damages is limited to foreseeable, typically occurring damage. Moreover, liability for damages is excluded.
2. Complaints regarding obvious defects will only be considered if they are made in writing within two weeks after receipt of the goods, the goods having been investigated immediately.
3. Based on our audit, we will repair or replace the goods that are afflicted with manufacturing and material defects free of charge.
4. The aforementioned liability is excluded when buying used equipment.
5. Minor colour variations, model modifications and technical changes designed for improvement do not entitle any objections.
6. If defects occur in components that are not manufactured by us, we are entitled to repeat the rectification once or to have it repeated.
7. If the rectification in accordance with Sections 2 and 5 fail, the customer may request a reduction or cancellation of the contract at his discretion .

8. Place of performance and jurisdiction
Place of performance for all payments is Rüsselsheim. For all deliveries, it is the place where the commodity is stored or delivered to by us. Place of jurisdiction for any disputes arising from this contract, and even with respect to the way it is awarded for claims based on bills of exchange and checks, is Rüsselsheim, as far as this is permitted by law. If individual provisions be or become ineffective, this shall not affect the validity of the remaining provisions of these Terms and Conditions.

9. Privacy Policy
Personal data of customers, which are necessary to complete transactions, will be stored on disk. The customer hereby agrees to this. The provider commits itself to treat all personal information as confidential and not to forward it to third parties, except as necessary for completing transactions.

10. Reference to battery legislation, information disclosure according to battery legislation (BattV)
Batteries do not belong in household waste. Since 1998, the Battery Directive obliges all citizens to dispose of used batteries exclusively by returning them to the store or by way of the specially provided collection points (statutory obligation to return). Retailers and manufacturers are required to take back and recycle these batteries properly or dispose of them as hazardous waste (statutory obligation to take back).

Batteries subject to labelling can be recognized by one of the two characters, consisting of a crossed-out bin and the chemical symbol for the classification as a pollutant heavy metal.
The chemical symbols (Cd, Hg or Pb) stand for:
Pb = battery / battery contains lead
Cd = battery / battery contains cadmium
Hg = battery / battery contains mercury

11. Reference according to packaging ordinance
In accordance with § 6 paragraph 1 of the packaging ordinance, we are taking part in the 'Dual System' in order to guarantee the nationwide collection of sales packaging. This participation in a licensing regime is ensured through our cooperation with the waste disposal company, EKO-PUNKT GmbH.
